General Terms & Conditions of Use

The purpose of these general terms and conditions of use (the “GTCU”) is to provide a legal framework for the terms and conditions under which the Fonds de Dotation Maria Callas makes the site https://www.mariacallas.fr available, and to define the conditions under which the “User” may access and use it.

The present GTCU are accessible on the site under the heading “Policies”.

The site is a public information site. It requires no account, no registration and no subscription. Browsing the site implies the User’s unreserved acceptance of these GTCU. A User who does not accept them must renounce access to the site.

The Fonds de Dotation Maria Callas reserves the right to modify the content of these GTCU at any time. The applicable version is the one published on this page at the time of the User’s visit.

Article 1: Legal information

The https://www.mariacallas.fr website is published by Fonds de Dotation Maria Callas, an Endowment Fund registered under the number 877558965, whose head office is located at 7 avenue de Bretteville, 92200 Neuilly-sur-Seine, France.

Article 2: Access to the site

The https://www.mariacallas.fr website provides the User with free access to information on the news, aims and sponsorship programmes of the Fonds de Dotation.

The site is accessible free of charge, from any location, to any User with Internet access, and without identification. All costs incurred by the User in accessing the service (hardware, software, Internet connection, etc.) are at the User’s expense.

The site offers no reserved area, no user account and no online payment. Donations are handled by an external provider, on that provider’s own site (see Article 6).

The Fonds de Dotation Maria Callas shall not be held liable for any event due to force majeure resulting in malfunction of the site or server, nor for any interruption or modification in the event of maintenance. In such cases, the User agrees not to hold the publisher responsible for any interruption or suspension of service, even without prior notice.

The User may contact the site by e-mail at the publisher’s e-mail address given in Article 1.

Article 3: Data collection

The site collects no personal data through forms: it hosts none. Personal data is processed only when a User writes to one of the addresses published on the site, and by the donation provider mentioned in Article 6, which acts under its own terms.

The site ensures that any personal information so received is processed in compliance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act n°78-17 of January 6, 1978. The User has the right to access, rectify, delete and object to his or her personal data, and may exercise it by e-mail to dpo@mariacallas.fr.

Article 4: Intellectual property

Trademarks, logos, signs and all site content (text, images, sound, etc.) are protected by the French Intellectual Property Code and, more specifically, by copyright.

The Maria Callas Foundation trademark is a registered trademark of Fonds de Dotation Maria Callas, and any representation and/or reproduction and/or use of this trademark, in whole or in part, of any kind whatsoever, is strictly prohibited.

The User must request prior authorization from the site for any reproduction, publication or copy of the various contents. The User undertakes to use the contents of the site in a strictly private context; any use for commercial or advertising purposes is strictly forbidden.

Any total or partial representation of this site by any means whatsoever without the express authorization of the website operator constitutes an infringement punishable by article L 335-2 et seq. of the French Intellectual Property Code.

In accordance with article L122-5 of the French Intellectual Property Code, Users who reproduce, copy or publish protected content must cite the author and source.

Article 5: Responsibility

The sources of the information published on the https://www.mariacallas.fr site are deemed reliable, but the site does not guarantee that it is free from defects, errors or omissions.

The information provided is for general guidance only, and is not contractually binding. Despite regular updates, the https://www.mariacallas.fr website cannot be held responsible for any changes in administrative or legal provisions occurring after publication. Similarly, the site cannot be held responsible for the use and interpretation of the information contained in this site.

The site https://www.mariacallas.fr cannot be held responsible for any viruses that may infect the computer or any other hardware of the Internet user, following use, access or downloading from this site.

The site cannot be held liable in the event of force majeure or the unforeseeable and insurmountable act of a third party.

Article 6: Hypertext links

Hypertext links may be present on the site. Users are informed that by clicking on these links, they will leave the https://www.mariacallas.fr site. The latter has no control over the web pages to which these links lead and cannot, under any circumstances, be held responsible for their content.

This applies in particular to the “Donate” links, which lead to the donation pages hosted by Donorbox (Rebel Idealist, Inc., United States). Any donation is made on that provider’s site, under its own terms and privacy policy.

Article 7: Cookies

The site places no cookies of its own. It uses no audience measurement, advertising or social network tracking, and embeds no third-party script for those purposes. No consent banner is therefore displayed.

The host may set strictly necessary cookies for the security and availability of the service. These cookies are exempt from consent under Article 82 of the French Data Protection Act. They contain no data allowing the User to be identified for any other purpose.

The User may in any case configure his or her browser to refuse cookies; browsing the site is not affected.

Article 8: Applicable law and jurisdiction

This contract is governed by French law. In the event of failure to resolve a dispute between the parties amicably, the French courts shall have sole jurisdiction.
